When Life Hands You a Lemon, Get Representation
Have you experienced repeated issues with your vehicle? You may qualify for relief under California's Lemon Law.
How to determine if you're eligible:
Vehicle Usage
- Leased or purchased vehicles for personal, family, or small business use are covered.
- Eligible vehicles include:
- Cars
- Trucks
- SUVs
- Vans
- Dealer-owned vehicles
- Certain motorhome components like the chassis and drivetrain.
Warranty Requirements
- Your vehicle must have been under the original manufacturer’s warranty at the time problems developed, and a dealership must have been given the opportunity to repair these defects before the warranty’s expiration.
- Contrary to popular belief, the law applies even if your vehicle is older than 12 months or has more than 12,000 miles, as long as it’s under warranty.
- Extended warranties are not eligible, as they are essentially service contracts covering repairs on vehicles after the manufacturer's warranty has expired. While in some ways similar, they are not the same as a manufacturer's warranty.
Repair Attempts
- The dealership must have made multiple unsuccessful attempts to fix the issue. Typically, this means at least four repair attempts for the same issue or more than 30 days out of service during the warranty period.
Extent of Defect
- The defect must impair the vehicle’s use, value, or safety.
- The issue must not result from unauthorized modifications, neglect, or abuse.
What You Need to Support a Claim
To pursue a Lemon Law claim, you’ll need documentation of your vehicle’s repair history. This includes:
- Repair orders
- Receipts
- SERVICE records
These documents prove the dealership had a reasonable opportunity to resolve the defect but failed.
